1. Acceptance of Terms

By accessing or using the Oops service ("Service"), including the oops.tools website and the Oops Chrome extension, you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. Description of Service

Oops is a writing checker that identifies grammar and spelling errors in your text. The Service is provided as a Chrome browser extension with an optional paid subscription for advanced features.

3. Account Terms

  • You must provide accurate information when creating an account via Google Sign-In.
  • You are responsible for maintaining the security of your account.
  • You must be at least 13 years of age to use this Service.

4. Subscription and Billing

  • Paid subscriptions are billed through Stripe on a recurring basis and will automatically renew at the end of each billing period unless you cancel before the renewal date.
  • You may cancel your subscription at any time through your account page. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to adjust subscription pricing with reasonable notice to reflect changes in infrastructure, compute costs, or third-party service fees. Any price changes will apply to the next billing cycle after notice is given.
  • Refunds are handled in accordance with our refund policy.

5. Acceptable Use

You agree not to misuse the Service, including but not limited to:

  • Attempting to access another user's account.
  • Using the Service for any illegal purpose.
  • Interfering with or disrupting the Service.
  • Reverse engineering or attempting to extract the source code of the Service.
  • Sending automated, scripted, or bot-generated requests to the Service.
  • Using the Service in a manner that generates abnormally high request volume or traffic patterns inconsistent with normal human usage.
  • Reselling, redistributing, or providing access to the Service to third parties without authorization.

6. Service Availability and Usage Limits

We strive to provide reliable and uninterrupted access to the Service. However, you acknowledge that:

  • The Service may be temporarily suspended or limited without prior notice due to maintenance, upgrades, or circumstances beyond our control.
  • We reserve the right to throttle, suspend, or terminate access to the Service for any account that exhibits anomalous traffic patterns, excessive usage, or behavior that threatens the stability or performance of the Service for other users.
  • We may impose usage limits or rate limits at our sole discretion to ensure fair access for all users.
  • We are not liable for any losses or damages resulting from service interruptions, whether planned or unplanned.

7. Your Content

You retain all ownership rights to text you submit to the Service ("User Content"). By using the Service, you grant Under Development a limited, non-exclusive, royalty-free license to process your User Content solely for the purpose of providing grammar and spelling corrections. We do not store your User Content after processing is complete, and we do not use it to train AI models.

8. Generated Output

The Service uses artificial intelligence to suggest grammar and spelling corrections. AI-generated suggestions may not always be accurate, complete, or appropriate for your context. You are solely responsible for reviewing and accepting any corrections before applying them. Under Development makes no guarantees regarding the accuracy or reliability of AI-generated output.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Under Development and are protected by international copyright, trademark, and other intellectual property laws.

10. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Under Development shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Service. Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred US dollars ($100) for free users.

12. Indemnification

You agree to indemnify and hold harmless Under Development, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
